Surgical Malpractice Results in Jury Award of $750,000

Jack Clark was scheduled for elbow surgery back in May of 2016. Clark would need to be put under general anesthesia for the surgery to take place. The defendants, a Certified Registered Nurse Anesthetist (CRNA) and NorthStar Anesthesia, provided the anesthesia care. Clark had the elbow surgery and two hours after being discharged, he developed a swelling in his neck and was rushed to the hospital. It was discovered that Clark was experiencing sub Q emphysema due to trauma during anesthesia.

This resulted in Clark having a 121 hospital rehabilitation stays with about eight weeks in a coma. Clark sued the defendants, alleging they were negligent when administering anesthesia during his procedure. The medical review panel in the case found 3-0 in favor of Clark. There was no settlement offer made by the defense and the case was left to be tried. As trial approached, one of the doctors on the review panel changed their position on whether the defendants reached the standard of care. The case was tried for five days and the jury deliberated for four hours, returning a verdict for Clark in the amount of $750,000.
